(b) In all cases of a Hindu Musa'man or other person subject to the jurisdiction of the Zillah having at his death left a Will and appointed executors and where the heir might not be a disqualified landholder the executors so appointed were to take charge of the estate of the deceased and to proceed in execution of the Trusts prescribed by the Will without application to the Judge of Dewani Ada [...] devolve upon a single heir ; that in the Mehals in question the local custom of the country should be continued in full force and that the Courts of Jugtice should be guided by it in the decision of all.claims to the inheritance of landed properties situated in those Mehals which might come before them. [...] By this Regulation the rules contained in sections 5 and 6 of Regulation V of 1799 were modified as follows :— 1. Whenever the Courts deemed it proper to provide for the administration or management of landed property a precept was to be issued to the Collector of the District wherein property was situate directing him to hold the property in attachment and to appoint a person for its due care [...] 2. In the case of a Hindu Mahomedan or other person subject to the jurisdiction of the Zillah Courts dying intestate leaving a son or heir who by the laws of the country might be entitled to succeed to the whole estate such heir if of age and competent or if not of age or otherwise incompetent and not already under the superintendence of the Court his guardian or nearest of kin by speci [...] (I.) By Act XX of 1875 called the Central Provinces Laws Act 1875 sections 4 5 and 6 of Bengal Regulation V of 1799 were deemed to be in force in the territories under the administration of the Chief Commissioner of the Central Provinces and the duties prescribed by the Regulation were to be performed by the Judicial Commissioner (Vide Schedule to Act).
