Mason says :—. The party may be imprisoned a long time before he shall come to be delivered by the law ; the ¶laces of his imprisonment may bin the furthest part of this kingdom ; the Judges always made the return of the habeas corpus answerable to the diso.nce of the prison from Westminstor4 the Jailor may neglect the return of the first process and then the party must procure an alias and the [...] In the next place I submit that this Regulation ought not to have the force of law because it is entirely beyond the.scope' of the powers conferred on the Legislature It is well laid down that if a Statute be open to two constructions and the one which is more open be disgraceful to the Crown dangerous to the rights of the subject and hazardous to the connection of India with the Crown ; wh [...] He may also be allowed to see his business servants at stated times once or tivice id a month in the presence of the Magistrate of the Ditrict or the District Superintendent of Police and the officer in charge of the Jail ". 3. That it further appears from the said records of the said Government of Bengal that a copy of the *id order of the 24th of July 1869 was forwarded to the Inspecto[...] 7. That I was Head Assistant in the said 'Bengal Secretariat prior to the arrest of the said Ameer Khan and have continued to be so down to the time of making this my affidavit and all correspondence and reports relating to the case of the said Ameer Khan came into my hands in the due and regular course of business and I have no recollection of any such report as the report referred to in the s [...] I trust that you will take a favourable view of this my application." 9.
