The case was decided on this point by two of the Judges who expessly declined to go into another question as to the validity of a direction to accumulate income the judgments of the third Judge in the appellate Court and of the Judge in the Court below on the latter point were therefore mere obiter dicta and the case is only an authority upon the construction of a particular will and should I thin [...] In the Indian as in the English Law Reports the favourite form is a resume of the facts followed by a short statement of the decision of the Court thereon This form of head-note is often prepared by taking from the judgment almost verbatim et literatim those portions which set out the general facts of the case and the finings of the Court (20 All. [...] But the reporter informs us in his heanote of the nature of the mortgaged property the amount of the mortgage moneys and the various stages with the exact dates of the litigation in the High Court and the lower Court between the mortgagee and the mortgagor. [...] Nevertheless the reporter has filled ten pages with a statement of facts the judgment of the High Court and the entire judgment of the Privy Council which sets out the exact terms of the mortgage-deed and the history of the suit in the lower Courts. [...] Only that portion of the judgment should be given which deals with the point for the sake of which the case was reported and the reporter should also eliminate all recitals of the evidence and the reasoning of the Court thereon.
