S. has given the award as shown in the annexure hereto; Now therefore in exercise of the powers conferred by sub-section (2) of section 15 read with sub-section (3) of section 19 of the Industrial Disputes Act 1947 (XIV of 1947) the Governor is pleased to make the following order and to direct with reference to section 17 of the said Act that the award be published in the Calcutta Gazette. [...] In view of the substantial increase awarded in the dearness allowance which will benefit all categories of workers the prayer for a general increase of the pay of workers drawing above the minimum pay is rejected. [...] 8 annas more for each set of 20 pans of sizes 1 to 6. The representtive of the Union has however overlooked the fact that the wages paid to the piece-rate worker for making the pans does not represent the whole of the cost of production of the pans for making 120 pans (six sets of 20 pans of sizes 1 to 6). [...] In view of the increase in the dearness allowance of timrated workers I hold that no reduction in the piece-rate should be made at least during the period for which the award will remain in force.4 The representative of the Union has urged that pans which become defective through no fault of the piece-rated workers e.g. [...] The Company's case is that this Union does not in fact represent the majority of the workers of the Company and the Company is therefore unwilling to accord recognition to this Union.
