If any expression contained in the preamble is not so large and extensive in its import as those used in other parts of the A ct or where the preamble goes further than the Act itself and the Court can collect from the expressions used in the body of the Act the real intention of the Legislature it is the duty of the Court to give effect to those expressions.3 2-A. [...] It is not permissible to employ the language of the proviso to enlarge the words of the enacting clause.' If the language of the enacting part of the statute does not contain the provisions which are said to occur in. [...] The marginal heading of a section is of no avail in the interpretation of the section if the express provisions of the section point to the contrary.8 But where the marginal heading is not in any way repugnant to the provisions of the section it may usefully be referred to. [...] of the Act through the Council reports of the Indian Law Gomm fbioners and of the Select Committees of the Legislatures the language of the draft Bill and the Statements of Objects and Reasons thereto appended and the speeches made in the Legislatures for the purpose of construing the enactments was reprobated by the Privy Counci1.5 It is not proper to obtain extraneous aid in order to constr [...] But in case of ambiguity or doubt it is permissible to call in aid the historical method of construtions It was suggested that the view taken by us of the Act is not in accordance with the 'intention' of the House of Commons or with `public understanding' of the effect of the Act ; and reference was attempted to be made to the debates ; but we have only to deal with the construction of the Act
