(2) Where any suit or proceeding relating to disputes in respect of any election of a member of a District Board or of a Local Board is pending on the date of the commencment of this Act either in a Civil Court or in the High Court or before the authority appointed before such date to decide such disputes under the said Act and cannot be continued by reason of the provisions of sub-section (1) [...] (3) The Judge holding an inquiry under section 180 of the said Act into the petition filed under sub-section (2) shall in assessing the costs of such inquiry under sub-section (3) of the said section 18C take into consideration the costs if any incurred by the parties in the suit or proceeding which could not be continued by reason of the provisions of sub-section (1) and may include such costs [...] On the completion of the work referred to in su(5) section (1) of section 13 the cost of the work shall be entered by the Authorised Officer in a final list of apportionment in accordance with the decision of the Collector under sub-section (4) and that portion of the cost which is so entered against the name of each person in the said list shall be the amount recoverable from that person. [...] (3) If upon the receipt of an application under clause (b) of sub-section (2) the High Court is not satisfied of the correctness of the Board 's decision it may require the Board to state the case and refer it and on the receipt of such requisition the Board shall state and refer the case accordingly. [...] (5) The High Court upon the hearing of any such case shall decide the question of law raised thereby and shall deliver its judgment thereon containing the grounds on which such decision is founded and shall send to the Board of Revenue a copy of such judgment under the seal of the Court and the signature of the Registrar and the Board shall dispose of the case accordingly.
