The facts of the case are shortly as follows:— (a) At the date of Colonel Walker's Settlement the Taluka of Koda Sangani was indebted to the Gaek war of Baroda for arrears of the tribute due to that State and other similar liabilities to the amount of Rs. [...] If the terms.of the mortgage were that Gondal was to enjoy the revenues of the village in lieu of interest on the sum secured by the mortgage of the village and that Kotra Sangani could redeem the village on payment of the principal sum advanced then the fact of Gondal's long possesion could not avail if not according to the Law of mortgage at least according to the law of Kathiawar as admitte [...] When my Counsel had explained to the Political Agent how far the evidence already before the Court left the point as to the exact nature of the transaction regarding Earmal &Iola in doubt he drew the Court's attention to the fact which was disclosed by that evidence viz that the transaction had t ‘len place before Colonel I/Va neer and requested the Court to refe r to Colonel Walker's Report as [...] At p. 100 in the above cane after referring to the pream."17 ble of the Act under which the register was made and kept and the object of which Act was the same as that of Colonel Walker's Settlement for tenures of the Chiefs and Talukdars of Kathiawar viz to give them permanence the High Court remarks :— and from and after such publication of the confirmation of the register relting to any [...] I will now request the attention of Your Excellency in Council to the following part of my appeal provided only that I should have the mifortune to fail—which I hardly think possible—in the request made in the previous part that the British Government should not refuse to determine this case by the light of that evidence which is in its own records and which is the best evidence of the transact
